Disputes involving Children
One of your prime concerns following a relationship breakdown will be the effect on your children. The courts act in the best interests of the children and are usually eager for parents to work together to reach an amicable agreement.
Under the law, married couples have equal rights with regard to parental responsibility. If the couple weren’t married the father will still have parental responsibility if he was named on the child’s birth certificate. N.B. this relates to birth certificates that were registered after 1/12/03. Where the father doesn’t have parental responsibility, he can apply to the courts for a Parental Responsibility Order.
